Take-out is different from delivery. Take-out means that people walk into the restaurant, buy food, and talk it out of the restaurant to eat. Delivery means they order over the phone or online and never set foot in the restaurant.

Um, can’t you just argue that Philly P’s is not a take-out operation, and just have more people eat there, thus rendering the argument null? I have never seen anyone order from Philly P’s, so that alone should count towards the fact that they aren’t really a take-out operation. I’m not a law student, so i don’t know this stuff, but it seems the DCRA’s logic is flimsy at best.
