The military commission at Guantanamo Bay detention facility in Cuba has heard an appeal by a convicted Yemeni national who had allegedly provided material support for al-Qaeda. Ali al-Bahlul was captured in 2001 for creating a 90-minute video in support of the terrorist group and its leader Osama bin Laden.

Washington claimed the video was used to train al-Qaeda, but now Bahlul’s attorney says his case should never have been heard by the military commission as it had no jurisdiction over it.

The Constitutional Attorney, Bruce Fein, says his client’s crimes should not be considered “law of war” offenses, as the “material support of terrorism charge” was not even a law, until 3 years after Bahlul was arrested.

“That’s a core prohibition against ex post facto laws. If you do something at the time and it’s legal, the government can’t make it illegal later. It’s a fundamental law of civilization that goes back to the Magna Carta of 1215,” he told Press TV’s Erin Connors on the phone.
