police officers are not allowed to search the room without a warrant or reasonable suspicion of a crime. however, the university can. it’s the university’s property that they are allowing you to stay in, and as such they can much more liberally search rooms, much like how principals at schools can search kids’ lockers. but realistically, when has anybody had their room searched besides when they’ve made DMT?

right…..

so they are not fully certified officers of the state, which means, you guessed it, in their capacities as DPS officers they are not bound by the case law mentioned by the author. Hence, DPS officers can search your room (insofar as the university ‘museum’ policy allows them to), or, as the author is well aware, pursue you through the ceilings of the Leavey center.

People do things that are potentially unconstitutional all the time. It’s even more of a grey area now that our security guards have “special police” commissions. And, as it appears from the article, plenty of people have prevailed with the defense that you’re trying to pooh-pooh, Ms./Mr. DPS Officer.

DPS officers are not officers of the state–they will search your room if they have any reasonable suspicion (broadly speaking) that you are committing a violation to the Student Code. They do not need a warrant. They do not need your consent.

This article is pretty stupid. And considering this was written by a kid who tried to drunkenly evade DPS and vandalized student offices in Leavey, it is actually quite comical.
